Depends on the year the building was built or the number of units.

Who it covers

  • Buildings built on or before Dec 31, 1996.
  • Buildings with 2 or more units.
  • Not buildings less than 30 years old.
  • Not owner-occupied buildings with 2 units or fewer.
  • Covers: Multiple-dwelling units in Passaic outside the listed exemptions.
  • Exemptions: Chapter exempts motels, hotels, one-family houses, two-family owner-occupied houses, certain single condo/co-op units, nonprofit-rented rooms, rooming houses, new construction completed after May 1, 1978, and units below $75/$60 per room. § 231-23 exempts post-1996 construction for up to 30 years or the initial mortgage amortization period, whichever is less; PILOT properties exempt until the PILOT expires.
